とするならば、死刑執行そのものに問題が生じる

死刑の言渡を受けた者が心神喪失の状態に在るときは、
法務大臣の命令によつて執行を停止する
家族の目論見は、①松本死刑囚の精神鑑定を再請求し、②心神喪失を認めさせた上で、
③死刑執行の停止を求める、ではないのだろうか

松本智津夫死刑囚が再審請求 オウム事件、２人目
地下鉄サリンなど１３事件で殺人、同未遂など６つの罪に問われ、死刑が確定したオウム真理教の松本智津夫死刑囚（５３）＝教祖名麻原彰晃＝が東京地裁に再審請求を申し立てていたことが１１日、分かった。
一連のオウム真理教事件では、５人の死刑が確定しているが、再審請求が確認されたのは元幹部岡崎（現姓宮前）一明死刑囚（４８）に続いて２人目。
１審東京地裁判決は松本被告を一連の事件の「首謀者」と認定して死刑を言い渡し、弁護団は控訴。２審で新たに選任された弁護団は「被告には訴訟能力がなく、意思疎通もできない」と公判停止を申し立て、最終期限までに控訴趣意書を提出しなかった。
東京高裁は２００６年３月、控訴を棄却。弁護団は異議を申し立てたが、同高裁が棄却し、最高裁も同年９月に特別抗告を棄却、死刑が確定した。
